It's important to understand that MOM typically gives the green light for LOC applications for secondary director roles within affiliated enterprises, such as a crucial subsidiary directly linked to the EP holder’s main job function. For director positions in companies not directly related, like investment funds, MOM might still issue an LOC, provided it aligns well with the EP holder’s primary job responsibilities.
Can a DP holder work remotely for an overseas employer?
DP holders are exempt from needing an LOC provided they satisfy the following criteria:
They are engaged in remote work within Singapore for a company based abroad; and
This company is an independent entity, distinct from any associated offices it may have within Singapore, ensuring there is no work-related link or interaction with the Singaporean office; and
They are not conducting meetings or offering services to clients located in Singapore.
Can S Pass or Work Permit holders be registered as company directors?
Absolutely not. Individuals holding an S Pass or Work Permit are strictly prohibited from initiating or overseeing any business ventures within Singapore. This means they are not eligible to register as sole proprietors, partners, or directors within any company that is incorporated in Singapore. Engaging in such activities is a direct violation of the terms associated with their work passes, leading to immediate revocation. Furthermore, they will be subjected to an employment ban as a consequence.
